'Like stubbing your toe and then like suing the ground': children, rights and their ability to participate in decisions that directly affect them
This paper reports on the findings of Alans PhD thesis, entitled The Voice of the Child in Family Law: Whose Right? Who's Right? It explores children's perceptions of their agency as decision-makers following their parents' separation and their understanding of their rights to 'have a say'. The paper argues for a new social perception of children as competent 'experts' about their own lives and as partners with parents in decision-making processes following separation. Implications for practitioners and researchers are discussed and a number of creative initiatives for child-centred practice that reflects children's views are explored.
